Introduction
This Agreement outlines the terms governing participation in the 247Partners Affiliate Program. By accepting this Agreement, you confirm your understanding and compliance with all terms, conditions, and policies set forth herein. Definitions
Key terms used in this Agreement include:
- Affiliate: The individual or entity applying to participate in the program.
- Affiliate Payments: Compensation earned through Revenue Share, CPA, Hybrid models, or any other agreed-upon commissions.
- Fraud: Any deceptive or unethical practices violating this Agreement, including but not limited to chargebacks, false sign-ups, and bonus abuse.
- Marketing Materials: Official promotional assets provided by the Company for advertising purposes.
- Prohibited Territories: Countries where the promotion of the program is restricted or not allowed by law.
Enrollment
To join the Affiliate Program, applicants must submit a completed application with accurate and truthful information. The Company reserves the exclusive right to approve or reject applications at its sole discretion and without the obligation to provide justification. Affiliates must comply with all applicable age and legal requirements for promoting the program. Marketing and promotional activities may only commence after the Affiliate’s application has been officially approved.
Marketing Guidelines
Affiliates are required to use only officially approved marketing materials and tracking links. Any modification, alteration, or unauthorized use of marketing materials is strictly prohibited. All marketing efforts must comply with applicable laws, regulations, and industry standards, ensuring content is not misleading or deceptive. Affiliates may not sublicense or distribute marketing materials to third parties without prior written consent from the Company.
Compliance & Restrictions
Affiliates must strictly adhere to all legal and regulatory requirements applicable to their marketing efforts. Promotional activities must not target minors or audiences in prohibited territories. Affiliate sites must not contain harmful, illegal, offensive, or misleading content, including hate speech, violent material, or unauthorized gambling content. The use of unauthorized bonus offers, misleading incentives, or deceptive advertising techniques is strictly forbidden. Spam, unsolicited emails, and any other deceptive or intrusive marketing tactics are not allowed.
Commissions & Payments
Affiliate earnings are based on CPA, Revenue Share, and Hybrid commission structures as per individual agreements. Payments are issued monthly, provided the minimum threshold of €100 is met. Affiliates are responsible for any currency conversion fees, transfer charges, or additional banking fees associated with payments. Negative balances will not carry over to subsequent months unless they result from fraudulent activities. Payments may be delayed or withheld in cases where verification, compliance, or legal obligations require further review.
Fraud Prevention
The Company actively monitors and investigates fraudulent activities and reserves the right to withhold payments in cases of suspected fraud. Fraudulent behavior includes, but is not limited to, bonus abuse, chargebacks, fake registrations, multiple accounts, or the use of VPNs to manipulate tracking systems. If fraudulent activities are detected, the Affiliate’s account may be suspended or terminated immediately, and all pending commissions forfeited.
Intellectual Property & Branding
Affiliates may use only authorized branding, trademarks, and promotional materials provided by the Company. Unauthorized domain registrations, keyword bidding on brand terms, or impersonating the Company or its brands is strictly prohibited. The Company reserves the right to request the transfer of any domain names, accounts, or assets that infringe upon its intellectual property rights.
Termination & Suspension
Either party may terminate this Agreement with 24-hour written notice. The Company reserves the right to suspend or terminate an Affiliate’s account in cases of non-compliance, fraud, or regulatory violations. Upon termination, all marketing activities must cease immediately, and all tracking links must be removed from promotional channels. Any pending payments owed upon termination will be processed based on compliance and performance history.
Data Protection
Affiliates must comply with GDPR and other applicable data protection laws when handling personal data. Any collected personal information must be securely stored and not shared with third parties without proper consent. In the event of a data breach, the Affiliate must notify the Company immediately and take all necessary measures to mitigate risks.
Liability & Indemnification
The Company shall not be liable for indirect, incidental, or consequential losses, including but not limited to revenue loss, data breaches, or reputational damage. Affiliates are responsible for ensuring legal compliance in their marketing activities and agree to indemnify the Company against any claims, damages, or losses resulting from their promotional efforts.
Amendments & Governing Law
The Company reserves the right to modify or update this Agreement at any time, with changes published on the Affiliate Program Site. Continued participation in the program following any amendments constitutes acceptance of the revised terms. This Agreement is governed by the laws of Malta, and all disputes shall be resolved in the courts of Malta.
